The driver is operating as a private driver. Only their personal auto insurance applies. Rideshare companies have zero coverage obligation. If the driver's personal policy is minimal, your recovery may be limited to those limits.

California law requires rideshare companies to maintain contingent liability of at least $50,000 per person, $100,000 per incident for bodily injury, plus $30,000 for property damage. This is contingent, applying only if the driver's personal policy doesn't cover the loss.
